Terms of service

1. The Seller

The mesojewels.com website (the "Site") is operated by:

MESO, a société par actions simplifiée unipersonnelle (SASU) under French law, registered office: 46 Rue La Fayette, 75009 Paris, France, share capital: 15,000 euros, registered with the Paris Trade and Companies Register under number 103 739 595 R.C.S. Paris, intra-Community VAT number: FR20103739595, director of publication: Marwan Nasrallah, contact: hello@mesojewels.com.

The Site is hosted by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. The domain name is registered through EuroDNS S.A., 24 rue Léon Laval, L-3372 Leudelange, Luxembourg.

References in these Terms to "MESO", "we", "us" or "our" refer to the company above. References to "you" refer to any visitor or customer of the Site.

2. Scope and acceptance

These Terms govern the sale of pieces offered on the Site to consumers within the meaning of the preliminary article of the French Code de la consommation and equivalent consumer protection laws of other jurisdictions where the Site is accessible.

Orders on the Site are reserved to natural persons aged eighteen (18) years or older with full legal capacity. By placing an order, you confirm that you meet this condition.

The Terms are made available on the Site at all times and can be downloaded as a PDF.

By confirming an order, you acknowledge having read and accepted these Terms without reservation. The Terms in force are those displayed on the Site at the time the order is placed.

MESO reserves the right to amend these Terms at any time. Amendments apply only to orders placed after their publication.

3. The pieces

MESO offers a curated collection of fine jewellery inspired by the civilisations of ancient Mesopotamia and the Fertile Crescent. Pieces are produced mainly in vermeil and 18k gold, with a small selection in sterling silver:

Vermeil pieces, ready to ship when in stock and otherwise made to order, crafted in sterling silver (925) gilded with 18k gold (5 microns minimum).

18k gold pieces, made to order, crafted by hand following confirmation of your order.

Sterling silver pieces, ready to ship when in stock and otherwise made to order, crafted in sterling silver (925).

Each piece is accompanied by a certificate of authenticity and presented in MESO's signature ceramic packaging.

Photographs, renderings, and descriptions are provided in good faith and reflect the essential characteristics of each piece. Slight variations may occur due to the handcrafted nature of the pieces, the natural properties of any stones used, and the display settings of your device. Such variations do not constitute a defect.

MESO reserves the right to modify, withdraw, or discontinue any piece at any time without notice. Orders already accepted remain unaffected.

4. Orders

Orders are placed through the Site by selecting one or more pieces, entering your billing and delivery information, choosing a payment method, and confirming the order.

Before final confirmation, you are invited to verify the details of your order and correct any errors. Confirmation of the order constitutes acceptance of these Terms and of the price displayed.

The sale is formed only upon receipt by you of an order confirmation email sent by MESO. MESO reserves the right to refuse any order in the event of suspected fraud, an existing dispute with the customer, manifest pricing error, sanctions or export-control restrictions affecting the delivery destination, or unavailability of the piece. In such cases, you will be informed by email and any sum already debited will be refunded.

For made-to-order 18k gold pieces, and for vermeil or sterling silver pieces ordered while out of stock (shown as made to order on the product page), production begins upon receipt of full payment. Estimated production time is communicated at the time of order, generally between four (4) and six (6) weeks, occasionally longer for more elaborate designs.

5. Prices, taxes, and customs

Prices are displayed in the currency selected on the Site. The default currency is euros. Prices in other currencies are calculated based on indicative exchange rates and may vary slightly at checkout.

Deliveries within France and the European Union

Prices are displayed inclusive of French value added tax (TVA) at the rate in force. Intra-EU B2C deliveries are subject to the One-Stop Shop (OSS) regime: VAT is collected at the rate applicable in the destination country. The price displayed at checkout is the final price; no additional duties or taxes apply upon delivery.

Deliveries to the United States, the United Kingdom, Switzerland, Canada, and Japan

For these destinations, MESO offers a Delivered Duties Paid (DDP) service. The price displayed at checkout includes all applicable duties, taxes, and import charges. The price you see is the final price; no additional charges apply upon delivery.

Deliveries to all other destinations

Prices are displayed exclusive of any local taxes, customs duties, and import charges, which remain the responsibility of the recipient. Duties and taxes vary by country and are determined by your local customs authority. We recommend checking your local customs policy before placing your order.

MESO ships on a Delivered Duties Unpaid (DDU) basis to these destinations. Refusal of delivery or unclaimed parcels due to non-payment of duties may result in return shipping and handling charges being deducted from any refund issued.

MESO reserves the right to modify its prices at any time. The price applicable to an order is the price displayed at the time of order confirmation.

6. Payment

Payment is due in full at the time of order, including for made-to-order pieces.

Accepted payment methods are displayed at checkout and include payment cards (Visa, Mastercard, American Express) and any other method offered on the Site at the time of order.

Payments are processed through Shopify Payments and Stripe, both PCI-DSS certified. MESO does not store payment card details.

In the event of refusal of authorisation by the issuing bank or any other anomaly, MESO reserves the right to suspend or cancel the order.

7. Delivery

MESO offers complimentary shipping on every order, to every destination worldwide.

Pieces are delivered to the address indicated by you at the time of order, by FedEx, UPS, DHL Express, Chronopost, or Colissimo, depending on destination. Delivery times communicated on the Site are estimates and run from confirmation of the order, or from completion of production for made-to-order pieces.

All orders are shipped fully insured and require signature upon delivery.

Risk of loss and damage transfers to you upon physical delivery of the piece. In the event of damage to the packaging upon receipt, you are invited to note your reservations on the carrier's delivery slip and to contact MESO within seven (7) days.

For deliveries outside the European Union, the recipient acts as the importer of record where applicable. Delays caused by customs processing are outside MESO's control and do not engage its liability.

Detailed shipping terms are set out in our Shipping Policy.

8. Right of withdrawal and returns

Customers residing in the European Union

In accordance with Articles L.221-18 et seq. of the Code de la consommation, you have a period of fourteen (14) days from receipt of the order to withdraw, without giving any reason.

Customers residing in the United Kingdom

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a period of fourteen (14) days from receipt of the order to cancel, without giving any reason.

Commercial return policy applicable worldwide

Beyond and including any statutory period above, MESO offers an extended return window of thirty (30) days from receipt of the order, applicable to all customers regardless of residence.

The exclusions provided for in Article L.221-28 of the Code de la consommation apply, notably for pieces made to your specifications or clearly personalised (such as a size outside the listed range, an engraving or a custom project). Made-to-order pieces from the collection and earrings are not excluded and may be returned within the same thirty (30) days.

The full terms governing returns and refunds are set out in our Returns and Refunds Policy, which forms an integral part of these Terms.

9. Statutory warranties

The pieces sold by MESO benefit from the statutory warranties provided for under French law, regardless of any commercial guarantee.

Statutory warranty of conformity (Articles L.217-3 et seq. of the Code de la consommation)

You have a period of two (2) years from delivery to obtain the implementation of the statutory warranty of conformity in the event of a defect of conformity. During this period, you may choose between repair or replacement of the piece, subject to the cost conditions provided for in Article L.217-12 of the Code de la consommation. You are exempt from establishing the existence of the defect of conformity within twenty-four (24) months following delivery.

The statutory warranty of conformity applies independently of any commercial guarantee that may be granted.

You may decide to invoke the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the Code civil. In this case, you may choose between rescission of the sale or a reduction of the sale price in accordance with Article 1644 of the Code civil.

Warranty against hidden defects (Articles 1641 et seq. of the Code civil)

You have a period of two (2) years from the discovery of the defect to invoke the warranty against hidden defects.

Customers residing outside France

For customers residing outside France, MESO applies the French statutory warranties as a minimum standard. Where the law of your country of habitual residence provides more protective rights, those rights apply in addition. This includes, without limitation:

the Consumer Rights Act 2015 for customers in the United Kingdom, which provides that goods must be of satisfactory quality, fit for purpose, and as described, together with a short-term right to reject defective goods within thirty (30) days of delivery,

the Magnuson-Moss Warranty Act and applicable state laws for customers in the United States,

any other mandatory consumer protection law applicable in your country of residence.

To implement any warranty, please contact returns@mesojewels.com with your order number, a description of the defect, and supporting photographs.

10. Commercial guarantee

In addition to the statutory warranties, MESO offers a one-year commercial guarantee on every piece, valid from the date of purchase. The terms of this commercial guarantee are detailed in the After-Sales section of our FAQ and in our Care Guide.

11. Intellectual property

The Site, its content (texts, photographs, illustrations, video, graphic charter, source code), the MESO name, the MESO logo, and the designs of the pieces are protected by intellectual property law and remain the exclusive property of MESO.

Any reproduction, representation, modification, adaptation, or exploitation, in whole or in part, by any means and on any medium, without the prior written consent of MESO, is prohibited and constitutes an infringement sanctioned by Articles L.335-2 et seq. and L.713-2 et seq. of the Code de la propriété intellectuelle, and by equivalent intellectual property laws in other jurisdictions.

Acquisition of a piece does not transfer any intellectual property right over the design of that piece.

12. Personal data

Personal data collected through the Site is processed in accordance with our Privacy Policy, drawn up in compliance with the General Data Protection Regulation (Regulation EU 2016/679, "GDPR"), the UK GDPR, the French Loi Informatique et Libertés of 6 January 1978 as amended, and applicable data protection laws in other jurisdictions, including the California Consumer Privacy Act (CCPA) where relevant.

You have the right to access, rectify, erase, restrict, and port your data, as well as the right to object to processing and to define directives concerning the fate of your data after death. These rights may be exercised by writing to hello@mesojewels.com or to the postal address indicated in Article 1.

You also have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) or with the data protection authority of your country of residence.

13. Liability

MESO undertakes to exercise reasonable care and diligence in the performance of its obligations.

MESO's liability is engaged only for direct, foreseeable damage attributable to a proven fault on its part. MESO cannot be held liable for indirect damage, loss of profit, loss of opportunity, loss of data, or any commercial damage resulting from the use of the Site or the pieces.

These limitations do not apply in the event of bodily injury, gross negligence, wilful misconduct, or breach of an essential obligation of the contract. They do not affect the application of the statutory warranties set out in Article 9, nor any non-waivable consumer rights under the law of your country of residence.

MESO cannot be held liable for any failure resulting from a case of force majeure within the meaning of Article 1218 of the Code civil, in particular interruptions of the Site, carrier delays, postal strikes, customs procedures, pandemics, armed conflict, or any event outside its reasonable control.

14. Site availability

MESO makes its best efforts to ensure the availability of the Site twenty-four hours a day, seven days a week. However, access may be interrupted at any time for reasons of maintenance, update, technical failure, or any cause outside MESO's control. Such interruptions cannot give rise to compensation.

15. Acceptable use and automated agents

You undertake to use the Site in good faith and for lawful purposes only. The following are prohibited:

any use of the Site for fraudulent, abusive, or unlawful purposes,

any attempt to interfere with the security, integrity, or normal operation of the Site,

any reproduction or extraction, in whole or in substantial part, of the content of the Site for commercial purposes,

any impersonation of MESO, of another customer, or of any third party.

Access to the Site by automated software, robots, scrapers, or artificial intelligence agents (including agentic AI), with or without supervision, is permitted only on condition that such agents:

i. identify themselves clearly in the user-agent header of every request, using the format "Agent/[agent name]",

ii. do not attempt to mimic human behaviour, circumvent CAPTCHAs, or otherwise conceal their automated nature,

iii. respect any restriction or instruction communicated by MESO, including through the robots.txt file, technical measures, or these Terms,

iv. respond truthfully to any prompt seeking to determine the human or automated nature of the interaction.

MESO reserves the right to block, restrict, or pursue any non-compliant access.

16. Feedback

If you submit ideas, suggestions, reviews, photographs, or any other content to MESO (collectively, "Feedback"), you grant MESO a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, and publish such Feedback in connection with MESO's activities, including for marketing purposes, subject to applicable data protection laws.

You represent that you hold all necessary rights to the Feedback you submit and that it does not infringe the rights of any third party.

MESO is under no obligation to use, retain, or respond to Feedback.

17. Mediation and dispute resolution

In the event of a dispute, you are invited to contact MESO first at hello@mesojewels.com in order to seek an amicable resolution.

Customers residing in the European Union

In accordance with Articles L.616-1 and R.616-1 of the Code de la consommation, in the absence of an amicable solution, you may resort free of charge to the consumer mediator to which MESO is affiliated:

Customers residing in the United Kingdom

You may seek alternative dispute resolution through an approved UK ADR provider. MESO will engage in good faith with any reasonable request for amicable resolution.

Customers residing in the United States and elsewhere

You are invited to contact MESO directly to seek an amicable resolution. Unresolved disputes are governed by Article 18 below.

18. Applicable law and jurisdiction

These Terms are governed by French law, without prejudice to the mandatory protections of the law of your country of habitual residence applicable under Article 6 of Regulation (EC) No 593/2008 (Rome I) and equivalent international rules.

Any dispute relating to the formation, performance, or interpretation of these Terms shall be submitted to the competent French courts.

Consumers residing in the European Union may bring proceedings before the courts of their place of residence in accordance with Article 18 of Regulation (EU) No 1215/2012 (Brussels I bis).

Consumers residing outside the European Union retain the right to bring proceedings before the competent courts of their place of residence where mandatory local law so requires. Nothing in these Terms restricts your statutory rights as a consumer under the law of your country of residence.

19. Miscellaneous

If any provision of these Terms is held to be invalid, unenforceable, or contrary to a mandatory rule of law, the other provisions shall remain in full force and effect.

The failure of MESO to enforce any provision of these Terms at any given time shall not constitute a waiver of that provision.

These Terms, together with the Privacy Policy, the Returns and Refunds Policy, the Shipping Policy, and the Jewellery Care and Guarantee Policy, constitute the entire agreement between you and MESO concerning the sale of pieces on the Site.

The headings of these Terms are for convenience only and do not affect their interpretation.
